United Kingdom – Changes to UK Data Protection Fee
The Information Commissioner’s Office (ICO) has made changes to the data protection fee structure in the United Kingdom. These changes are effective as of the 17th of February 2025.
Background
In September 2024, the government consulted on proposed changes to the data protection fee. Legislation has now been laid in Parliament and with the new fees in effect as of the 17th of February 2025.
Key Points
- Who’s Affected: All organizations and sole traders processing personal information, unless exempt.
- New Fee Structure:
Tier 1: £52 (previously £40)
Tier 2: £78 (previously £60)
Tier 3: £3726 (previously £2900]) - Implementation: Any payments made after the 17th of February 2025 will be subject to the new, higher fees.
The Risks of Non-Compliance
Companies must ensure timely payment to avoid registration expiry and removal from the public register. Non-compliance or incorrect payment may result in fines up to 150% of the top tier fee.
