Luxembourg – New Filing Requirement to indicate National Identification Number
The Luxembourg Business Register has implemented a new obligation, requiring all natural persons registered or due to be registered with the Luxembourg Trade and Companies Register (RCS) to provide their Luxembourg National Identification Number (LNIN).
Effective the 12th of November 2024, this number must be included in all RCS filings for relevant entities.
The requirement applies to all Luxembourg entities with any natural person registered with the RCS in any way, including managers, directors, shareholders, representatives or auditors.
What are the steps to obtain a LNIN?
Non-resident individuals must apply for an LNIN with the RCS.
The following information must be provided in order to create a LNIN:
- First & Last name (as on supporting identity document);
- Date, place and country of birth;
- Gender;
- Nationality;
- Private home address (number, street, postal code, locality, country);
- Electronically signed a copy of identity document;
- Proof of address / residence certificate dated less than 6 months; and
- Proof of the professional reasons for applying for the LNIN.
Individuals that already have a LNIN can directly be registered in the appropriate filing forms via the RCS with no extra supporting documentation needed.
The risk of non-compliance
Failure to comply with this requirement will result in the RCS platform blocking future filings for affected entities, potentially leading to business continuity issues and additional adverse consequences.
